Civil and Commercial Litigation

Solcargo has a group of highly specialized attorneys concentrating on civil, commercial and international litigation and dispute resolution. Solcargo counsels clients with respect to civil and commercial plenary suits originating from both contractual and non-contractual claims; executing and enforcing foreign judgments in Mexico in accordance with Mexican and international law (Hague Convention); executive mercantile actions to collect on secured debt and negotiable instruments (e.g., promissory notes); mortgage foreclosures; bankruptcy proceedings; voluntary jurisdiction proceedings; and payment and collections matters.

Our expertise involves all types of suits brought before federal and state courts and all phases of judicial proceedings including “Amparo”, which is a constitutional provision particular to Mexico.

Solcargo has successfully represented both domestic and international corporations such as Promotora Inmobiliaria La Cima (a subsidiary of ACS, a major Spanish conglomerate) in its litigation regarding a construction project in the tourist town of Acapulco; Mobiliario Urbano, a subsidiary of Clear Channel Communications (NYSE CCU); and Gupta Technologies (an American company specialized in software development) in a claim against the Mexico City’s Federal District Government. We have also represented FLACSO (a UNESCO-sponsored academic international organism) in its claim for diplomatic immunity before Mexican Courts, which set an important precedent for future cases.
